When you purchase a single family home, there are conforming guidelines, or minimum guidelines every lender agrees to follow, and lenders can add their own set of rules above and beyond conforming, but I have never had a lender run a criminal background check on a borrower for a home. But when it comes to commercial.. there are no conforming guidelines.. each lender will have their own set of underwriting rules and regulations.. and if they choose, they can run their own type of check on the borrower.. Depending on how much your looking to borrow, it's quite possible the lender will look at your criminal history as well as your credit, income and assets.. Depending on what your conviction was and how long ago, it's possible it wont even matter if they did run your criminal history, but be advised that they could.. I recently had a client looking to get commercial financing to complete construction of a 150 unit motel. The borrower touted his experience and how he had been involved over 10 large projects.. Our commercial lender ran a criminal background and found out that the borrower did not lie.. he was involved in 10 large projects, with each one of them ending with a law suit.. they denied his loan... As noted, there generally is no criminal background check, though sometimes due to the type of crime there might end up being a court report on the credit report that is pulled, and then that would have to be worked through. You may want to pull your credit reportto see if that is the case, so that you know what to be prepared for when you talk with your lender.
