I am legally married and own a home with my wife. I separated recently with my wife and I want to buy a house. Can I buy a primary home in Florida without my wife on the title? We are not legally separated or divorced. by darvin850 from Miami, Florida. Dec 2nd 2022
Yes. Assuming you qualify, it is one to buy, all owners to sell or refinance. Remember though, typically in this situation, the moment you buy the house, as you are married, she is 1/2 owner, regardless if you were the "only buyer". I lend in WI, MN, IA, ND, SD. No, I am not an attorney, but while you are still legally married, a primary home would be considered a martial property, and your wife would have to be on title. She would have to sign the note acknowledging the debt and CD, but not the mortgage. This would only have her acknowledging the debt and not be responsible for the mortgage. In these situations, with cooperating parties, the spouse will typically sign off the deed to the other spouse.
