This is a tough one.. Just about every lender out there will say no... but I have heard of other loan officers who say they have had success with them.. The problem is that when you file BK, and you do not reaffirm your home mortgage, then you are no longer responsible for any present or future losses incurred by your lender.. you can continue to stay in your home and so long as you continue to make the payments, the lender will continue to accept them, however if you decide to just walk away from your home, the is no financial obligation since your home loan was included in your BK.. Some lenders say that you need to be 4 years post discharge date, and other lenders say you can do a HARP refinance (assuming your loan is eligible), but again.. I don't have a lender that will do one.. try searching Google to see what your up against.. but be forewarned.. it's not going to be easy.. I'm a Broker here in Scottsdale AZ and I only lend in Arizona. Helen, as William mentioned, this is a difficult situation. I have "heard of" people who offer this option, but have never personally met a lender or borrower who has successfully closed a transaction like this. Be prepared to hear a lot of nos and also be wary of anyone who says yes a little too easily. Make certain you are working with someone reputable and that they have all the facts before you proceed with anything.
Like everyone stated above this is a very tough one. Please contact several lenders and feel them out to see what you get you may just get lucky.
