Can I take over a mortgage that's not in my name when I'm the only one on the deed?

I currently have a home that was left to me as a child. When I was a minor my guardian refinanced the loan in her name only. She never gave me the home when I turned 18. I'm 32 now and want the home but she is not working with me. There is still a mortgage and I want her off. It is all going to be about who is legally the owner. Assuming you are the owner, you can take out a loan on the property, but you can't just do it without dealing with the existing one. usually that one is paid off. I'd suggest starting by finding out who is the legal owner of the property. Good luck
