Assuming your current loan qualifies for HARP and you meet all other eligibility requirements, then yes... under HARP guidelines, BK's, short sales and foreclosures are ignored.. Your loan must have been originated prior to June 2009 and must be owned by Fannie Mae or Freddie Mac.. They both have websites where you can type in your info and it will tell you if they own it and whether or not it qualifies for HARP, but you probably should have a mortgage professional help you with that.. the websites are very particular.. I've had borrowers tell me the results said their mortgage did not qualify, when in actuality it did.. Example: Typing "1234 Main Street" vs. "1234 Main St." will produce different results.. If your loan is not HARP eligible, then you can refinance with FHA now assuming you are 3 years or more from the discharge date, and you meet all other eligibility requirements, and for conventional you will need to wait till 4 years from the discharge date..
