I paid 2 payments at the beginning of my mortgage to always be a month in advance, BUT...

Yes.. if they are reporting incorrectly, then it is (in a civil suit, but not criminal)... However, if you contact your mortgage servicer and talk to them, you can probably get it cleared up.. It's possible that one of your payments got applied as an additional principal payment rather than an advanced payment.. but communicate with them.. they should be able to clear it up. .
