in NY, when the former spouse deeds the marital residence to the other spouse, do they remain liable on note if done by CEMA?

A CEMA loan is no different than another type of refinance in the sense that the old loan is being paid off.. and a new loan is taking it's place.. so if you are the ex spouse, and you are on the old loan, then by all means, let your ex refinance.. it removes you from liability..
