More info needed,,, specifically whether or not you had a mortgage included in your BK.. If there was a mortgage involved.. then it's unlikely you will find anyone willing to do it. Typically, construction loans require no foreclosure for 10 years.. Understand that there are no "Conforming" set of rules for construction loans.. each lender that does them will typically have their own set of guidelines, but most have adopted the 10 year waiting period if you had a foreclosure.. If there was no foreclosure.. then another rules that seems to be adopted is a 7 year waiting period for borrowers with a BK.. The better option would be for your parents to apply for the construction loan.. once the property is complete, then you purchase it from them with a gift of equity of $40K.. Assuming you meet all other eligibility requirements, there are loan products for borrowers with a 6 year old BK7.. I'm a preferred Lender with California and Arizona being my primary markets.
