Is this considered legal advice?

It depends on your state. Most, if not all states allow a married person to apply for credit either by themselves, jointly with their spouse, or jointly with another person that is not their spouse. Based on this, unless the loan office is also a licensed Attorney, then it would not be legal advice. BUT, I would venture to say that letting you know that you can exclude your husband (estranged or otherwise) is valid LENDING advice.
