Your asking a bank to modify the terms of a mortgage that you originally agreed to.. And more than likely, it's a losing proposition for BofA.. of course they will drag their feet.. if it weren't for the federal government's involvement, they wouldn't offer any type of assistance.. It's possible that you won't have a modified loan for 9 months to a year... and you could go the whole distance only to be denied at the end, or your modified loan only drops your payment $40... Here's a quick test.. take your monthly combined income before taxes, husband and wife, and Multiply it by .31% ( Example: $4000 X .31=$1240)... if your monthly mortgage payment is higher than that number, then your payment could be modified down to that number.. if your monthly mortgage payment is lower than that number, then you are wasting your time, your loan will not be modified.. Yeah they aren't fun to deal with. Only suggestion with them is be patient and stay persistent.

Yeah BofA is one of the worst. I would look into using an attorney that does this for a living.
The only way to "escalate" in any significant manner is to employ a Real Estate Attorney to work on your behalf.
