My family and I have lived with my dad in his home for the past decade. I have made all mortgage payments for him but the loan is in his name. My dad passed away a few weeks ago and I have no idea what to do. My dad gave me a quit claim deed but I am not on the mortgage. First off, I am so sorry for the loss of your dad. You have a lot on your plate, and you shouldn't need to worry about the home. Since you have been making payments, it is probably safe to assume the loan your dad has was NOT a reverse mortgage. Reverse mortgages do not require monthly payments. The mortgage statement can help identify the loan type. If it is a reverse mortgage, give me a call so I can give you important information on what will be expected of you BEFORE you reach out to the lender. Now if the loan is NOT a reverse mortgage, then there is little to worry about. Estate law puts certain restrictions on mortgage loan servicers when it comes to property passed by inheritance. As long as you KEEP MAKING THE PAYMENTS ON TIME, it is extremely unlikely the bank will do anything. You will want to get the title into your name but doing so without notifying the bank of your dad's death could start a process that will add more stress and aggravation to your life.
