There really isn't anything you can do on your second HELOC mortgage. It isn't owned by Fannie or Freddie and they are not obligated to help you modify it. The only thing you can do is ask them for help, which it sounds like you have done, and it is entirely up to them whether they wnt to help you or not.
If you used HARP, it was a refinance not a modification... and the 2nd has no obligation to refinance you or modify you in any way.. Keep in mind that loan modifications will usually result in a negative hit on your credit report since most will require you be behind on your payments and you must prove that you have suffered a hardship, or show you don't have the ability to continue making payments.. Please don't think that if you stop paying and fall behind they will help you. Most of them won't do that, even if you are late. You will have to prove you have a financial hardship that is preventing you nfrom making the current payment, and that does not appear to be the case. HARP has no hardship requirement. In fact, HARP requires a borrower to qualify, which works against you for the second mortgage. Second mortgage holders are under no obligation to help in any way. Most of them are arguing that the higher rate you agreed to is now more appropriate because they have a higher risk especially if you are under water. If they are telling you they will not help you, then your best course of action is to take the amount of money you are saving on the HARP refinance and apply that as extra principal on each of your payments to the second to retire it faster. As property values increase and your principal balance falls, you may reach a point where you can convince them, or another lender to refinance. It is a tough situation for you on the second. Your Second mortgage servicer is not obligated to modify you.
Like the others have stated, you are in a tough position as there aren't any government programs to help you unless you combine both loans into one with an FHA loan to 97.75%. HOWEVER, I have had a couple clients were in the same situation and I told them to go into the Bank directly, the one that is servicing their loan, and talk to the manager at the branch and see if he/she will help you. It's a long shot but for 3 of them it actually worked once they could put a name to a face rather than be just a number in a computer system. Good Luck. I agree with the answers, but am wondering if you can offer a few more specifics about your current situation. Was the 1st modified or refinanced? Did you get an appraisal done? Do you know what the loan to value is? As mentioned in one of the earlier answers FHA allows for 97.75% loan to value, so it could be an option, but without a better idea of your situation I can't give many details.
