Neighbor Building Fence on New Property

I closed on my house January 3rd. I recently purchased a copy of the original lot and building plans for my home, from the city. I wanted to look at the lot size for my property and neighbor because they recently rebuilt their fence (while my home was in escrow) and I found out that their fence is over their property line, on our property. How would I go about notifying my lender? Am I able to restructure the loan based on the land I am missing vs. what I was sold? by johnh957 from Perris, California. Feb 11th 2019 Reply

This situation has nothing to do with your lender. The lender does not own the property, you do.. they funded the loan so you can purchase the property.. Any property line disputes are handled through your county assessors office. The place to start would be to have your lot surveyed so you know exactly where the property lines are. Then, if the fence is on your lot, the neighbor would be obligated to move it at their expense.. if they don't move it, or they wont move it, you can sue them to have it moved.. But again,,, your lender has nothing to do with it. I'm a preferred Lender with California and Arizona being my primary markets.
