You can refinance with whomever you choose. Your old lender gets paid off at closing.
There is no requirement or penalties for refinancing with a another lender however if you have a pre-payment penalty on the loan you currently have then you may have some additional costs but that would be added to your payoff amount. You can use any lender you wish.. and realistically, your existing lender in most cases is the last lender you should call.. typically, since your already a customer, they usually don't offer the best rates, however they are the only one's that can offer you financing with the least amount of paperwork if they choose. The best advice I can give you is to contact a LOCAL mortgage broker and apply with them. By applying with your LOCAL Broker, you have an advantage because he's familiar with local customs and works with numerous lenders, seeking out the best loan terms for your particular scenario. You can refinance with any lender of your choosing and your current lender has no say in the process. I would contact a local loan officer or two and have them give you their best refinance options. Best wishes, Sean
