Your information is incomplete, but if the question is, I had a home where the first foreclosed and the second was charged off by the lender, then you may or may not still owe the balance, even if it is not appearing on your credit report. Appearing on the credit report has no bearing on the legality of owing the balance and accrued interest to the lender. Whether you still 'legally owe it, or said another way, if the lender is still legally allowed to demand payment has to do with timing. Each state has a statute of limitation that allow a debt to become uncollectable with the passage of time. In most cases debts where there has been no collection or payment activity for more than seven years, the lender is not legally allowed to pursue collection anymore, the debt becomes uncollectible. Different types of secured loans can have longer time limits. Do some research to see if the debt you are referring to is outside the statute of limitations or not.Bert Carpenter, The LoansA2z Team of NEXA Mortgage ~ NMLS 40586 ~ Certified Mortgage Advisor and Certified by The National Association of Mortgage Professionals as a Certified Veterans Lending Specialist.Licensed in AZ, CA, GA, IL, MO, OR & WA...
