Are you thinking about transferring your real estate into your existing or newly established Living Trust? Tread cautiously. A recent trend by banks is to issue an acceleration demand to borrowers that "Transfer Title" out of their name and into the name of their Living Trust. Wording in most Deeds of Trust, the document that secures the lenders Promissory Note dictate that before any transfer of title, Prior written approval MUST be obtained from the lender. This would also include adding or deleting anyone to the title. Best advice is to make sure you apply with your lender for approval BEFORE you record the change. You should also run your plans past your attorney as well.
